So, it's 700 pm on December 8th. This is the Town of Dartmouth Planning Board meeting. And please note that this meeting is being recorded. Also, the planning board voted in public meeting to continue meeting virtually in accordance with the governor's 2025 extension of the virtual/hybrid open meeting option through June 30th, 2027.

Uh, this is for 293 Flag Swamp Road, also known as map 79, lot 34-1.

Uh this application is brought forth um by the DNRT for property for a project they're working on at that address. Um the we have a comment on the portal from um Mr. Barbara who is our tree warden.

Uh Mr. Chairman, would you like me to read that into the Please do.

Okay. This again, this is from um the DPW director and tree warden, Mr.

Timothy Barber. Um, thank you for marking the trees. After walking along the area of the proposed tree removal and confirming the lack of sight distance from the driveway entrance, it is apparent that some tree removal makes sense from a safety standpoint. However, I cannot confirm that all of the marked trees need to be removed at this time. I re I recommend removing many of the

smaller diameter trees and the evergreen trees with low growth that are blocking the sight distance around the curve on Flax Swamp Road and then taking another look at the site distance from the driveway entrance to confirm whether additional trees should be removed. I also recommend planting replacement trees elsewhere along the frontage of the property where trees may have been

removed due to damage or disease in the past. Setback trees may also be an option for the replanting. Um, so I think at this time, um, we have a representative from the DNRT and also Mr. Barber is here to answer any questions the board might have after, um, the representative makes makes his presentation.

All right. Thank you. Uh, board members, if uh, if you don't mind, I'll just share my screen for a few quick slides to go into a little bit more detail on what Mr. Goso just laid out.

Okay, I've requested that permission and here we go.

[clears throat and cough] Great. Well, as you all know, um my name is Nick Wildman. I'm the executive director of the Dartmouth Natural Resources Trust. Uh anybody who knows DNRT knows that it's very much in our mission to preserve trees and protect trees. We don't take the removal of them very lightly. In fact, uh this is um kind of unusual for us. But in this case, given the safety considerations,

it's a request we must make. So, uh we are talking about Flag Swamp Road. Uh this is a approximately 43 acre parcel that DNRT purchased two years ago, former cranberry bog. and it is also protect not just in our care and uh custody but also covered by a conservation restriction that's held by Mass Ottabbon.

Right now, we're working to open the property to the public for walking trails uh in early 2026.

The area we're focused on tonight is really at this southern point. You can see Flag Swamp Road running north to south, the bog area here to the east of the road. And the area we're talking about is at the southern end of the property. This is where an existing uh BM exists and an existing driveway out to Flag Swamp Road. And this is the only area under our conservation restriction

where DNRT is allowed to put parking for public uh use. [clears throat] So, it's really important for us that we take advantage of this. We have currently have a con um excuse me, a notice of intent in front of the conservation commission. Uh that hearing has been um pushed forward until December 23rd uh for the site improvements related to that parking. But as a part of designing

this parking with our consultants, uh we recognized the difficulty posed by the group of trees here. And this figure I'm showing here from our application. Flag Swamp Road runs left to right that's kind of turned otherwise it's north to south of course we're proposing parking and in fact the configuration of our parking was actually set up this way to conserve the larger trees that you see

in this area at the bottom of the screen. But what we have here is a horizontal uh curve that is uh you know causes some challenge especially as many of you know drivers tend to go pretty quick as they come across the bridge that's here just south of the property and coming down from the residential area up north. So this curve is really a tricky one to navigate. Uh there's no

painted line in the middle of the road.

And you know, this is the view looking south from where folks would be entering Flag Swamp Road from our property. In this case, Flag Swamp Road here you can see is on the right. Uh to the left, this is looking south. So to the left or east is the bog property. And this is the wall of of greenery that is concerning us.

As I just mentioned, our design plan calls for saving the pine trees that are over to the left here. But this wall of dense vegetation has been causing us some concern. So we went out there. We actually counted every single stem. It's a it's a variety of species and a variety of sizes.

And looking at it a little bit closer, you can see it. It's it's quite a mix of both. Um we have some arborvite, we have some maple, think we have some white pine in there as well. And you know, I believe this must have been planted as a screen back during active arming of the cranberry bug or something like that.

Um, but right now it's completely overgrown and blocked sight of that uh horizontal curve. So, basically to cut right to the numbers here, um, these are all of the trees that are present in that line. They're all in almost a straight kind of curving line with the road. Um if I go back you can see they're set back from the road edge of road by you know probably about 8 feet

or so. Um and after so we had initially submitted our application to the board requesting the permission to flush cut and remove all of those trees. I had a really good conversation with Mr. Barber last week after he got the chance to review the site and looking it over um you know kind of talked through some of talked through the comment that he had submitted to the portal and you know we

agree that you know it's in our we're always protecting trees all all over the place and so um in this case we want to follow Mr. Barbber's advice and take out the smaller trees. You know, I'll go back a couple slides. You can see there's some very thin, you know, we have some very small diameter trees in here that are just kind of cluttering up that line. In this case, we propose to

leave, let's see, nine trees all above 6 in in diameter. So, those are established good solid trees, red maple and arborite that will provides continue to provide shade, continue to provide that habitat and that scenic view. Um, but we think we'll allow for enough line of sight for drivers coming in and out of that driveway to do so safely. That's really our number one concern here. Um,

as you can see, there's a a few different uh species, a few different sizes here, but you know, DNRT plans to hire an actual tree company to do the removal. This will not be work done by uh volunteers given the safety concerns and given the location. So this is one we want to approach really um from a safety perspective.

Furthermore, you know, it's our perspective that this cranberry bog is really an important part of the heritage of North Dartmouth in this part of town.

Flag Swamp Road is a beautiful road to drive and a great scenic beauty. But by actually removing these trees and opening up that view to the the bond complex, you know, we feel that this is actually going to improve the scenic quality of the road by giving drivers a safer chance to kind of look to their side, look and see that historic landscape here. So, um, we're pleased to take Mr. Barber's advice on this and,

um, with your approval, we can make these improvements for safety.

That's about all I prepared.

I'm well. yourself.

Good. Thank you. Um or what is your perspective? Sorry to put you on the spot, but what is your perspective between your letter and the changes they made and what he just summarized?

Well, I think ARACK, you know, having a good conversation with Mr. Wman. I think, you know, they they their goals are the same as ours to to conserve nature the best we can and um and preserve as many trees as we can. And but I think you know safety is utmost importance as well and and that is a it's quite a a horizontal curve and and the site distance is is lacking because

the amount of trees. So I think I think thinning out the the amount of trees out there will will will help with the sight distance and it'll open up like like Nick Nick said open up some of the the aesthetic view of the of the site as well. And and you know, my recommendation is to do that and and and and look back at the site distance. If it still needs some more trimming, then

you know, we can move forward with that.

But I think I think it'll definitely help by removing a lot of the smaller smaller trees and brush.

Good evening, Stephen Souza. Please obviously state your name and address if you don't mind. Sorry. Uh Steven Souza, 254 Flag Swamp Road. Uh my question is the letter indicated it was um looking at uh clearing some brush and trees along for a parking area along 293 Flatmark Road which is the complete opposite event is what was just described on the on the um meeting diagrams. So I'm just a little confused

as to where that pockin is actually going to be.

Yeah, I'd be happy to show the the plan if that'd be helpful.

Yeah, Steve, thank you. And Nick, if you don't mind, take the floor again. Um, we'll help you share your screen and let's make sure we're precise about this.

Yeah, this is the same plan that we've submitted for the conservation commission's review. There's a number of uh wetland resources under the town's bylaw and the state wetland protection act. Um, this I believe the the address was listed correctly and the um certainly the assessor's map and parcel number are correct. So, um, in other words, there's an existing burm here.

Our proposal, uh, before the conservation commission is to widen and flatten that, uh, apply gravel and establish parking for five spots in this location.

Nick, can I interrupt you for a moment?

Yeah.

Yeah. Just from the public's perspective being that it's a plan with a cursor, could could you zoom in and just start over and indicate where you were along the drive just so everyone can follow more clearly?

Oh, sure. Yeah. You know, I never can tell what's being shared and what's not on these things.

No, the plan is being shared, but I'm just in respect of the public perhaps. Zoom in if you can.

Yeah, I can do what I can on that.

Whoops. Here we go. That's a little better. Okay, so here we have Flag Swamp Road in this case running left to right, but also north to south. This is the existing driveway. So, we want to take advantage of the impact of the burn that's been there since the 1970s at least.

We're proposing a gravel driveway, gravel parking for five spaces here at the beginning of the trail head. We'll have some signage here, typical of other DNRT reserves. The two parking spaces here are because our conservation restriction limits us to a maximum of seven parking spaces. At this time, we don't actually intend to construct these unless we feel there's a big need for

parking and and a safety concern. So, we we're permitting them. Um, our hope is that we'll begin construction on this in early 2026 and this will sort of be an ad alternate. In this case, we're keeping the mature trees that are grown here.

There's a big nice white pine. I think maybe there's two white pines and some maples here. And it's really just this row of trees here that we're concerned about.

Going back to Stephen Souza. Steve, your question was also specific to the number that we're uh we're describing 293 versus a different number.

Yeah. Um on on the street, the address of 293 is um north of that location. Um so it was confusing in the letter that it was is north of that location. What's being being shown here? And I did see where um they have marked off trees with um pink pink uh ribbon um in the area.

So it was confusing as to where this um driveway and parking location was actually going to be as it appeared through the letter was going to be much further north um of the location that they're currently showing.

Okay. Your concern ultimately was that the flag trees were flagged with the intent of becoming parking.

Um well posially, but I I was unaware that that was actually where the parking was going to be. I was under the impression um based off of the letter um and the certified letter that we had received earlier in the in the um last month um that the parking area was going to be further north than um what it's actually showing.

Understood.

Yeah, I agree that the 293 flag swamp simply comes from map geo from the you know um so the assessors it's all one lot and so the map and parcel is the best way to describe it but I certainly understand the confusion using that number because there are other houses on you know that are along with the bogs. So that's where the concern came from as well.

Um he he did clarify the the question.

Um it is a little concerning that that's going to be you know a driveway and parking area basically right after the curve which is can be dangerous especially in the winter when it's icy and it hasn't been sanded or anything.

Um as many vehicles have gone off the road in that that area.

Um the only other question I have is um you know is is is all this you know in conjunction also with the PD and patrolling and stuff with that area like I said due to the accidents and so forth in that location I believe and the board can help me since I'm uh my tenure is less than others here that that's more of a traffic related question I believe correct board members correct Okay,

Steve, sorry. I wish I wish I could give you uh valid information, but you know, I think the question goes towards traffic.

Um yes, basically you have two options.

Um we could we could you the planning board could could close the public hearing, make a motion to approve u with the conditions, you know, Mr. Barber over overseeing the um the tree removals and his recommendations.

um or if the board sees it fit that they need any information then it would be a vote to continue.

So I'd like to just share the fact that u I'm greatly appreciative that Mr. Tim Barber is here tonight and I'm not sure that there's any reason to continue this unless a board member feels differently.

So I'd like to hear from the board at this point in time.

Uh, not so much of a question. I just want to, you know, throw my um on on record here. I appreciate the thoughtfulness that um Mr.

[clears throat] Barber and and and Dan have taken um in the proposal. Um we have to be mindful of the safety on the travel of that road and the sightelines that are being um that are there that are present. I also very much appreciate the fact that the recommendation takes a measured approach to the removal of any trees and not just um run the risk of taking any more than absolutely necessary. So, um, given the

recommendation, I think it's appropriate to, um, to kind of do it as a phase.

Let's, let's take a few out, see if, uh, we've meet we've met the intent, um, of providing adequate safety around that corner without, um, removing any more, um, trees than absolutely necessary. So, I'll leave it at that.

All right, so uh we're back in our planning board meeting. Brings us to administrative items. Uh item number one, approval not required. PR-25-80 High Hill Road.

Dan, do you want to jump in on that?

Sure. This is um an application um for an endorsement of an approval not required plan um filed under PNR 25.8. 8 application on the online portal. This is for High Hill Road, um known as Assessor's Map 82, lot 15 and lot 15-1.

Um this is a a pretty s simple um land swap. um the lot in question, they're looking to take a uh 3.9 acre piece of the the rear of the property um and have it um transferred to the the parcel in the back also owned by the applicant. Um so this is allowed under 1.102 102 of the Dharma subdivision subdivision regulation that states conveyed changing size and shape of lot providing that

every lot so changed or affected by such change as frontage as required by the zoning law bylaw or maint maintains existing non-conforming frontage and 1.0103 103 which states creation of parcels without the required frontage as long as apostles created it are labeled non-buildable and the reason the law is non-buildable is noted on the plan u which it is it's listed as as like I said parcel one um and the note that

parcel by law parcel one by itself is not to be considered as buildable lot and is to be combined with assessor's map uh 84 law 25.

So it my recommendation that this is eligible for endorsement by the board.

I believe there's somebody here if they for representing them if the board has any questions would be the project Dan Malloy for the applicant some site design I don't have anything to add to it I think uh Mr. Joseph covered it just fine. Was here to answer questions.

If there are questions uh and/or opinions that anything we should entertain before voting on it, we can.

Uh I was also made aware that the luxury of voting on this tonight, if we see fit that we need to make changes in the future, uh we can within the confines of our scheduled planning board meetings.

So, we're not jumping through hurdles or awaiting town meeting dates. So, keep that in mind in terms of making progress now and any future amendments uh will be possible as we see fit. So, if anybody has any questions or comments, let's do it.

I I didn't see anything that was wrong with uh the changes. A lot of it uh I think was um absolutely fine. I didn't see any major problems that I saw with with the uh revamp of this.

Great. I and just just to chime in, I I feel the same way as Margaret and um I spent 37 minutes before this meeting specifically on this item um in preparation of this meeting. So I too feel the same way and respect and appreciate the built-in luxury that if we have to make changes in the future, it's a matter of making them within our meetings.

As far as agenda item number three, ongoing discussion and Dartmouth futures zone zoning. Um, I just want to exercise a little bit of caution. We have a meeting an interim meeting scheduled next week. So, do we want to chat now? Does anybody have anything new or or or perhaps something we haven't heard before or do we want to save the majority of this discussion for next Monday's meeting that we

scheduled for this very reason?

Uh Mr. Chairman, if I could just add something real quick.

Um so a couple things. Um Ross has prepared a a new plan showing the areas all the board members came in and discussed. So we'll have that ready to go. I also reached out to Sered. They're going to have the draft goals um for the housing production plan available for us to use to discuss on that meeting as well. Um and we can talk about the progress of the housing production plan

is still on schedule to have it done by the end of the year and then come before the board um early next year, hopefully in January. But I just want to mention that we'll have those two things. And if any of the board members have any other requests, anything they'd like to see, um, please feel free to reach out to Ross and or I to, um, have that ready for you for the meeting next week.

I'd like to wait till next week to discuss it because we're meeting next next Monday. Correct.

Correct. It is. And I have a question about I appreciate that and I'm at a minimum I'm with you, Margaret. Ben, in your opinion, is next week's meeting, although it had great intent, slightly premature, should we be waiting for the housing production plan um from a constructive perspective, or do you feel proceed and have next week's meeting? No, I think I think having th those draft goals, I think that'll let

the board see what came what came of all that those meetings and discussions and then we can kind of, you know, really fine-tune which direction the board wants to go in in in regards to the housing questions and um you know, we can hit the ground running next year, right? Okay. I appreciate that. Anybody else as it relates to tonight versus next week?

More importantly, if nobody has anything to share in terms of the future zoning tonight, then um you know, quite frankly, we'll push through this agenda item tonight and plan on working on it next week.

Um we had um our the woman that was doing our minutes um she she has resigned from that position. Um it was great working um with her through this past year. Um but she has decided to move on to um other opportunities. Um and working with the town administrator, they as best as I can tell they have somebody willing to take it on. I gave him the meetings that still need to be

um transcribed only the last meeting um and obviously this one after tonight's meeting. Um, so I we should be able to get those um ready for I would say probably the not next week for the special meeting but for our next um meeting and if not I will give the board an update on what is going on with the progress of getting those minutes transcribed.

uh you know on on that item I I know when I came in to uh to talk with you guys I I I brought up uh you know my experience with some of the meetings that I've had uh for for business were covered by uh applications like Otter AI where where the you know the minutes were summarized with action items and and it was uh a very tight process. Do

do you know if the town has explored that?

I I told the people about our discussion.

They were going to look into it, but for now, this is the process they want to go through, but it is something they're monitoring. I guess certain boards have tried to do AI programs in the past.

that hasn't been entirely up to what their um what their standards they want to be, but it's something I think everybody's definitely will will keep looking at as we as we advance on that technology.

Kevin, I appreciate that and I'll just voice my opinion. Uh I am with Kevin.

there are a world of solutions uh and technologies available that this could be handled uh that way. So hopefully with an open mind I'm with Kevin in the future we'll be using some of those technologies especially in the in the case where it it's not like we're looking to displace somebody you know it's it's more of a situation where we don't have anybody.

No I I agree 100%. It's kind of like it's the optimal way to employ that technology. It's at no expense of a human being, right?

Just just just to clarify, there is, like I said, I am being told there is somebody that is is on the books that to handle it going forward. So, Okay.

Uh I I noticed and I the the letter uh to Mr. Basset and I was just kind of interested in your take on what's going on there.

He is he is working with the with the property owner. Um, I pretty sure there was a the cease and desist letter given.

Um, and that's the last I have for an update on that property.

There were no plans submitted with it. Um, so there's not much I could really comment on it. My thought or comment was just, you know, this will require a site plan review application

at a minimum um based on seeing future future plans. So, there's not much else I can really add. I don't know if the board members have anything they would like me to add to the comments. I got to get those um to the ZBA tomorrow morning. Um they're waiting on that for their hearing on Thursday. So, like I said, if there's nothing else the board would like me to add, I would just add

the standard statement that you know, site plan review will be required at a minimum and other filings may be required once we find once we actually have site plan submitted.

2026 planners report.

Uh in the packet we had the the schedule um for meetings for for 2026.

Um I believe this was briefly brought up at the last meeting. Um so if if no board members have any issues then we will we will post that that um that meeting schedule.

Great [clears throat] master plan implementation report with planning department updates.

I don't either at this moment. Um, brings us to number six, the chairperson's report.

I look forward to next Monday's meeting.

I'll be open with everybody. Um, I look forward to that and then I look forward to the housing production plan.

On a personal level, I feel a little bit delayed, a little bit slowed, a little bit stuck um as it relates to what our needs are, what our hopes are, and which way we're going to make it possible in writing. But nonetheless, I I look forward to collaborating next Monday and not only my thoughts, but putting our thoughts together and coming up with something directionally, meaning forward

and constructive. Um, the other thing I wanted to share and it is premature Kevin Estes is up in 2026. I hope he stays for the next 26 years. I'm up in 2027.

I just wanted to share that I continue to get questions with a tilted head. So, how do you like the planning board? And what why I'm sharing this with fellow board members is people do know that we're involved and some people are curious and when they ask that question it almost tells me that they too wish they could help or wish they could get involved or show it maybe an indirect interest in getting

involved. So I I do my best to take a few minutes to explain why I enjoy the meetings and being involved and trying to give back and collaborating with everybody. And I just think that when it gets close to an election, all of our mindsets, depending if there's a vacancy coming up, our mindsets go there. It's like a paradigm shift. Oh, there's an election. Let's find someone. And I don't think that's

the right way to go about it. I think we should take the time periodically to share with others what we're doing and what it means and how we do it and to groom their interest so that when there is a vacancy in election rather than looking for one person maybe we have two or three individuals that are interested. So, um, this just happened to me in the past couple weeks, the how

do you like it and how's it going multiple times and I'm just sharing that because it gave me an opportunity to reflect and share with them what we do, how we do it, and and why we do it. So, um, with that in mind, I don't I don't have anything else to share at this moment. I look forward to next Monday to be transparent with everybody. Um, my schedule's been a little complicated and

I'm going to be reaching out to some of you one on- one just so we can kind of outline and put our thoughts together for next Monday so we can hit the ground running. But I'm happy to have I'm happy to hear back from anybody um at this point in time if anybody wants to share anything.

And if not, it's early. I don't want to be that guy.

Well, I can just say Mr. Chairman, just to make a point that our next meeting is December 15th at 7 p.m. and that will be in room 3:15 at the town hall. So, anybody that watches this now or um later recorded on DCTV, um that meeting will be in person in room 315 at 7 o'clock next Monday, December 15th. Thank you, Dan.
