Waterways Management Commission Meeting - April 28, 2026

I will go ahead and call the meeting to order and start off with a roll call.

And I'm here obviously. Um so the first order is to uh vote on the minutes from last month's meeting. Is there any a motion accepted?

Item three on the agenda was a report on the Buttonwood Debay 5-year project update, but um uh Rachel can't couldn't be here today once we change the date.

So, we're going to um recoordinate with her for a future meeting.

All right, Steve. And then we see dredging report and addendum reports.

Yeah, I thought we had closed this grant out. It was a Seapport economic council grant that we had received a report and then an addendum. We did go over budget, but FA had agreed to wave the overage for the addendum because of our long-standing business with them. Um Cody the town administrator would just like to get a vote of approval from the waterways commission to accept that so

that we can do the close out on the grant. I don't think anything changes but we are going to need to start thinking about step two in the process which would be the design engineering and permitting.

Okay. And those were sent away on when?

It was like last last fall or so. Did we Yeah, I thought I had I guess I didn't do that for this meeting, but I can uh resend the dredge report and the addendum.

Boy, I really I know we looked at them, but yeah, I'll I'll resend those out today, but there were no comments or I think beyond getting the work from the bridge to the landing, that was the crux of the addendum and that was done, but I don't think there were any other issues or problems um because the project is over budget um and we got and we're going to we're

going to have a second uh discussion on phase two. Maybe we can vote on acceptance and anything that is uh any issues or questions that come up when we when we review the report again uh we can address in phase two.

All right. And the marina status, it's done. Um, we are again very close to closing that out. Uh, still within budget. I have not got the final invoice from FO for their last the latest work which is the installation of two fingerps.

The um the only issue that I want to address last year the commission set a limit of boat size 20 ft including the outboard and I think we're going to have to expand those parameters uh so that we can fill the marina and it's something that we can revisit each year but at this point I'm getting a lot of requests from 20 and 21 foot boats that would fall under the 25 foot length overall.

So my suggestion for advice from the council, from the commission would be to expand the overall length to either 25 or 26 ft.

Well, Steve, we always said this first year was an experimental year in finding out who would show up, what the need was, what the want was, what the appetite was. So this is great that they're getting large slightly larger boats. So, I for one am all for adapting our our plan to increase to add to the voters there. So, I make a motion to expand that to 26 feet and allow you to,

you know, tell those folks, sure, come on in. We'll happily allow those slightly larger boats.

I think that we would get greater use and thereby greater revenue by expanding the parameters and and I don't see a downside to it and if it needs to be revisited again in the future we can certainly do that.

Well, we're only in our second year so this is great that people are asking.

It's I think this is good news.

Yeah. And you don't you don't see you don't see any downside of we go big it'll be harder to bring them back down later?

I I don't think so because each year it's almost you know we're not guaranteed that everyone's coming back and if we don't fill it because you know there are people with 25 20 21 footers that want to be there then we're wasting the asset. Um obviously it's subject to first come first serve and what's available. So yeah I I think we could if we wanted to in the future go to a total dingy marina where

nothing over 12 or 13 feet, but I don't think that's going to be necessary and I don't think that's wise.

Can I can I ask one question on that?

What do we do? Um it it's hard I agree with Andy. It's hard to go backwards. Uh although I'm in favor of expanding obviously we want to fill it but once we once we tell people they have a spot do we tell them it's a spot for every year until they cancel or we try we renew them every year at our our pleasure. The only reason I'm asking is it stops people from looking for another place

and if they find out in the spring that they don't have a spot then that that's a problem.

We never really defined that. I treat it like the mooring permit where everybody has a moing permit under state law for one calendar year and we allow renewal of that permit if all the rules are met, the regulations are met.

So yeah, obviously I mean if we lost that pier in a storm, there wouldn't be a pier for anyone to tie up to. What do we do then? Is there an expectation or a responsibility? I I don't know that that would follow, but I think if the rules are obeyed, if the boat doesn't change, the parameters don't change, we have safe use, I think it's in the contract that um safe use is a requirement to

continue. So, it's kind of vague, but if someone is um let's say not a good boater, not a good neighbor, then they don't have to stay or No, I would agree with that. My like I said, my only my only worry is we wound up with um you know five I'm making numbers up. Five 25 footers and now you know we basically we had planned on having you know 10 boats on the dock and

we can only have five now. But I guess as long as we're getting the revenue and we haven't lost the spot because we've expanded it is fine with me.

We we have requests for dingies that people want to pay for their dinghy to be there and that may only be 10t long or 12 feet long. Uh, and then, you know, so we kind of offset one with the other.

You get a 25-footer and then you get a 12-oot Avon. Uh, again, the only reason I'm even asking this is we never sused out exactly what it would be because we didn't know until we built it and started using it.

Uh, and we have another first year coming up because the two finger peers have just been added. They need to be marked or labeled or designated as spots. So, we've s significantly increased the linear footage of birthing with those two new fingerprints and uh yeah.

So, I'm kind of looking at this as our second first year with a marina because it is a little bit different.

Yeah. kind of going along what Andy said, I would just make sure we just don't get four, you know, get get away from four or five big boats in there and limits the amount of people being able to use the resource. Um, yep.

You know, in my eyes, I think having a couple larger boats probably makes sense, but maybe not all large boats.

Um, yeah, one thing if we don't have any if we don't have any interest at all and they're just not being filled, then I think there's an argument then just fill them with larger boats. But Sure.

Well, Steve, we always planned even way back when it was going to be a mix of larger boats, whatever that number is, and smaller boats. So, let's see what happens in this second first year.

And I I also believe that the depth of the inside finger pier is going to limit the size of the boat that will willingly take that first or westernmost finger pier. So, How about um one last not not to keep beating this one last should we have a should we have a beam a maximum beam too just in case somebody shows up with a catamaran uh you know you can keep a rabbit hole all

day on this I I I understand where that's going. I I think if we call it a monohull only we don't you know catamarans they won't fit between the two finger pins. So yeah.

Or or the round boats. I mean, you know, it's I don't know what's coming next.

I don't either. Flying boats.

Uh, yes. So just with one comment I would catamarans in general are becoming really popular in the uh motorboat category especially in the 25 to 26 foot range. So using a monohole designation there might not be um the best. You might want to put a beam there.

Just my opinion and I mean yes. Do we want to go back and and amend the motion?

Amend it with a with a beam or I don't know what the maximum beam would be. I mean it's probably like 8 foot eight or eight 8 foot or something like that, but it might the the way the dock set up, Steve, might dictate that. I'm not sure.

Right. I'd rather get a measurement in between the two, divide it in half and and use that. Um, you know, how about we add one last piece? It um, you know, final determination by the hybrid master of appropriateness of the vessel or something along those lines.

Because they keep coming, honestly, Jamie's 100% right. They keep coming up with like new versions of boats that don't even look like boats anymore, right?

So 5A under this uh agenda item, it select board is requesting a presentation from me on May 11th, that's the Monday, um before I guess not may have the wrong day there, but regarding the use and occupancy of the marina and how it's going basically um be happy to report the revenue from last year. I have that uh the increase in boat numbers that the add-on will allow and uh

and we have not impacted parking at all.

I'd rather have have them hear that from the uh park department, but yeah, there's been no crisis of parking.

So, I uh I plan on being invited uh for the 11th, right?

And Roger, he can say that it that everybody learn because they worked together. We wound up with a nice marina and everybody had nice parking and it didn't impact anything because we all worked together. Right.

Oh, sure words have never been spoken.

And how about the dinghy and kayak racks?

I have a willing uh contractor and I've tried several different attempts to get people to build these.

The guy who built the prior uh iteration of the kayak and dinghy rack is willing and able to deliver. So, I have the funding from community preservation. I have the warrant article for kayak and dinghy. Between the two of those, I'd like to um spend up to that amount, making a slight change, removing one dinghy rack and replacing it with two kayak racks. That'll give us uh eight spaces versus 10. And we can move some

So, if there's no objection, I'll push the go button on that. It'll be an easy transition. Uh either we do it before May or after May. If there are kayaks that are need to be moved, we can do that, too. So, it'll be an ongoing project, but uh I think it's what we've been waiting to happen.

Well, we've seen the boating population evolve from dingies into kayaks to paddle boards and uh we're we're adjusting our uh space accordingly. I think it's great, Steve. Keep keep going that direction and there's no permit modifications required because well, I didn't bother to do that in the beginning and I'm not going to do it now. So, yeah.

Um so that's it for the dinghy and kayak replacement. Uh we again expect to be at capacity and no vacancies, but um right now we're reassigning a few that have decided not to renew for the 26th season. And we'll still get requests right through the summer as people discover what we've got. uh we get requests to accommodate.

So I think we've done well going from what used to be a haphazard beach array of abandoned dingies to um probably triple what was there disorganized.

Excellent. And and it as we promised uh our good friend Buddy Baker Smith, this is becoming self-sufficient and self sustaining.

Absolutely.

Yeah. I think going way back, the first iteration of the dinghy rack that we designed and built out of Trex and lumber was given a fiveyear lifespan.

That was 20 years ago.

So we've been lucky. We've been fortunate with the weather.

And uh it's they're getting better in design and construction. So we'll see how that goes.

The next item.

Yeah. How about the the meeting with the park board?

I have the wrong date and again not knowing my upper from lower body parts.

It is supposed to be Tuesday, May 12th.

It'll be a joint meeting that's being requested with the park board at the park board meeting. There'll be a presentation from Brewster Thornton. That's another typo. Brewster Thornton is the town hired um consultant that is doing the planning board review for the entire peninsula. highest and best use resilience all the things that some of the things we looked at before and more

so that I will get a start time but it's going to be in the evening it's going to be a live meeting park just wanted to know that commission would be willing to attend and then send out the evite for that so it does save compromises Brewster Thornon will not have to present to two boards individually but just do one combined presentation on that night.

So, it won't it will not be a Zoom meeting?

No, it they're planning to do a presentation live and it will be at town hall, but you don't know when.

I believe 5:30, but that has not been confirmed. So, I didn't put a time down.

Yeah, I had I had 5:15 in my notes. I don't know if that's But May 12th, correct? May 12th, not May 10th. May 10th is a Sunday. There are no meetings.

It's Mother's Day.

Oh, yeah. Even more reason not to have a meeting.

Unfortunately, I have um a prior commitment on the 12th and I'm very disappointed because it's something I would like to attend. I'm wondering if the meeting gets um the meeting gets uh recorded if um they would accept late comments.

I'm sure they would because this is a work in progress. This is like uh not really a kickoff meeting because they've done that with the departments. But uh I I could ask the meeting be televised or recorded by DCTV and I think it would be important the public.

The only thing I'd be concerned about is whether or not the scope um has already been finalized and so that might limit what we can speak about. Okay.

There is a meeting tomorrow on this project. I can ask.

Well, yeah. Luckily, this is not a waterways project. It is not a park department project. This is a town planning department. Uh yeah. So, the planner is actually running lead on this, which is good. It's not necessarily leaning towards either department.

I believe the park department meeting starts at 5 and they thought that this would be number two on the agenda. So 515 was an estimate maybe, but I see I should be able to be there for that.

And how about the uh Roger Street boat ramp feasibility study?

I thought this project was gone or dead, but it is still active. I'm working with Rachel. Rachel is our substance abuse coordinator, but she's interested in doing more. So, we're working together on This is an engineering study for the area boat ramp. Can it be revived? Can it be redesigned, repositioned, or just discontinued? and CEI is the contractor that the town hired. Chris Vitali before

he left set this all in motion. We have had one meeting with CEI, a virtual meeting and expect that they'll come back after doing some sampling studies and surveys of the area. I think they were going to try to coordinate with Andy and community voting, but they're just taking another look at the area again with funding that's left in the Seapport Exchort economic council grant.

Uh they've changed the scope slightly so that it really is just feasibility more so than engineering or permitting.

But, uh, I'll fill you in more as I hear from CEI.

Yeah, they they were they were down here this week. I went over and said hi to the engineers, but they were uh just doing their thing. So, hopefully it it'll be some pretty quick progress.

Yeah, the time limits on these projects are rapidly approaching the deadline.

So, I think before summer is up, we'll have something in hand.

Is it is the contract um over June 30th?

I believe the grant funding runs for both of these through June 30th. I don't know if an extension is an option or a thought at this point, but What's Rachel's last name?

I wasn't planning on posting that because I don't see that as being a joint meeting or anything like that.

It's more of a presentation.

I'm hoping to be there and um health department uh it it's being promoted by Round the Ben Farm as well as other agencies in town.

And then are we at maritime center issues?

We had a sinkhole show up out of the blue in the western most parking spot.

Um, no idea why. That whole area seems to be plagued with potholes or sinkhole.

It was not due to the snow. It was not from freezing. It literally was a hole that developed and the pavement dropped into it. Uh, there's one that's been patched in the crosswalk that was removed. There's one on the south side of Bridge Street and a second one on the south side of Bridge Street is starting.

So the town sent the facilities people down there and they cut it open, found that it was more extensive than it looked. They filled it in with sand and dirt and then patched it. Cold patch.

So, it's no longer a safety hazard, but I don't think that we're going to see the last of the sink holes in that area.

What do they think it is all fill under there?

It is. It's certainly And then the building itself had significant excavation.

So it it goes back quite a distance and it's on the waterfront with like a rock revertment and waves come in and rain goes out and it creates these voids. But there's no um we pulse in the rock in the wall.

Not that I've seen the the wall that's there goes probably back to the 1800s if I had to guess. So, uh, we did once it was brought to my attention, I worked with the facilities people. I put down a barrel and tones and they brought in a metal plate and the next day did the actual construction and repair. The dock gate was noted that it wasn't closing properly. So, again, I worked with Harvey Baraby from

facilities. We were looking at ways to reposition the post that holds up the gate. And Jav decided it would be easier just to uh shave and move the uh hinge further south so that it would close.

I believe it's all settling. It's the weight of the gate, the checking of the wood. So, we stay up on things like that as best we can. And uh still looks like ready for opening Memorial Day weekend.

Steve, Steve, I have a quick question on that gate. Um Sure.

Is there a reason why we need a gate on that dock? I was just That might morph into more of a question because I think we were I don't know if there still is limited hours on access to that dock, but I believe there was on the initial um introduction of the facility. There there was those hours were instilled for the um for the neighbors basically. They were afraid that would become an

attraction late at night after the bars closed. Um so we posted the hours. We don't lock the gate and um it's more of a friendly neighbor type thing. So it's never been removed. The the sign is still there. Uh, and the gate, I mean, it does stop little kids from going where they shouldn't go. It's a safety issue to some degree, but um, yeah.

Okay. Yeah. As long as it's uh I would just my question was the long locking it. I didn't know if it was getting locked nightly, but because I did I did have some interest of why it would be locked like I think it was eight o'clock at one point. Some people coming in transients trying to go to dinner. I mean, I would think eight o'clock would be um that's not really helping people

get in and out of there and use the facility.

No, it it's it's um there was the agreement worked above my level, the town and the former neighbors. I don't know if you're all aware, but that house has actually been sold to a new neighbor.

Oh, interesting.

Yeah. And uh staggering price, but gentleman needed a place to keep his boats, so he bought one.

Uh, I I don't expect that it's an issue anymore, but um I think having it there and pointing to it and keeping trouble from finding its way down the dock is easier than not having anything in place. The other I don't know benefit of having it is if we get a storm, we get some weather that we don't want people going down there, then it serves a purpose to keep people who

are going to find themselves in harm's way from being down there.

But it is a balance between letting people get off the water and keeping people from getting into trouble.

So it it isn't locked, right? It does not get lock.

There's no lock for it. No.

What's the latest on the shallop boat?

It's coming uh August. Get my calendar out again to make sure I get the right date. This is a I think it's going to be a really interesting uh little shot in the arm for our town.

August 15th.

Can't I can't open the calendar again, but uh let me see.

I know I can. Let's see. May August 16, 17, 18. And then it's going to Andy, isn't it? And it's going out to Cuddy Hunk. It's going to be they're going to be they're going to be sailing hard.

It's due to arrive here the 16th or 17th. That's a Sunday or Monday of August. It is going to spend the night in Peyton. a day and and a night. Uh we're looking at using Hathway Marina and having event uh educational tents set up like a I don't know what you call it, but one of those event tents, little pop-up tent probably.

Yeah. Yeah. Nothing permanent, nothing overnight. Um but the public's going to be invited. There'll be talk by the onboard crew that's moving it from Westport eventually back to Plymouth.

It talks at Plymouth. Uh so it starts in Westport. It works its way here. It will be ushered along the way by the boat that is next to the maritime center. That large Oh, that's what she is.

Yeah. I was kind of trying to figure that out, too.

Yeah.

Yeah. That lodge boat is is uh the William Underwood and it was built by founder of the Underwood Company and it went out and caught I smelts or sardines I guess sard it's a sardine carrier.

Sardine carrier and it was integral in the canning of sardines.

uh a main boat builder restored it for his private yacht and Richard Armstrong bought it I guess last year.

So that will be escorting the shallop which is an open boat of about 30 foot length in its voyage all the way out to Nantucket.

When it gets the shallop gets to pay narrow, it may stop at the yach club for an event there. Limited duration, but it will proceed through the bridge to the town landing.

And for the night that it's spending in Peyton, it is likely going to transit back over to the maritime center and tie up at that dock while the crew sleeps aboard the Underwood. for the next doc over.

Uh there is plans to have a movie that would uh run in conjunction with this visit and that would be the Paul Cuffy biography which is being done now.

It's uh another educational like uh relevant to this actual boat.

So that will be either viewed in the maritime center at the fire station or at the uh cultural center. Final destination for that movie hasn't been determined, but the town is interested in making this an event. So Heidi Silva Brooks from the select board has been involved.

I've reached out to Brock Cadero.

Those of you that know Brock, he's a local guy uh who was I think he wrote a dissertation on Paul Cuffy and his impact in the area.

So Brock will be on board and Susan Gduchi is also involved as is Richard Armstrong's brother John Jonathan Armstrong.

So, I don't know what the town plans or envisions for the village for the town itself to welcome and promote this, but I kind of sense that it could be another mini uh village stroll centered on the visit.

Nothing quite as extravagant as the stroll or the summertime festival, but definitely making good use of the maritime center.

I'm looking forward to it.

Yeah. Oh, the other thing I just realized is that this boat, although it's historically accurate in its dimensions, it does have power. It's got an electric auxiliary, so it is able to move through the bridge to the landing back to the maritime center.

Although it'll look like they're rowing it, it'll be assisted with electric propulsion easers.

Yeah. Don't don't tell anyone that part.

We're my office is planning on being available to escort it. Uh DCTV is going to be there to record and film.

And uh I offered electrical accommodations when they do tie up at the maritime center for whatever purpose they need the electricity for.

But all right, sounds sounds good.

And when I visit the select board at that meeting in May, I plan on playing up the importance of the maritime center in a visit like this as well, so they don't lose the idea that it's not just a boater amenity, but a real public asset.

Well, we Yeah, we always wanted it to be an asset for the whole town, and clearly it's turned into that.

Yeah, I've got one. I've got one. Um uh May 30th, um CDC and the Azorians are going to kind of be doing a joint open house at Community Boating Center. Um just more this is moreformational.

Um basically getting people access to the water. They want to check it out. So they'll be free sailing, kaying, paddle boarding, and then the Azorans will be doing some rowing with their whaleboats.

So that's uh Saturday, May 30th from 10 to 2.

Cool.

There'll be some there'll be some food trucks in the CBC driveway and I don't know, some fun and games for the kids, but just trying to get people on the water.

Excellent. Excellent. Andy Andy, I heard your presentation on the local radio for CBC with two of your workers, student workers. I thought that was excellent. I really I'm sure it's archived somewhere, but uh I hope presentation fine.

Yeah. No, it's good. It's, you know, it's it's important to get the kids involved. You know, I I can I can tell you what they think they get from the experience, but better from their mouth.

And then we're still doing sticker pickup on the Memorial Day weekend.

There were two weekends. I believe it's the weekend before and the weekend of Memorial Day, but yeah, we've gotten a few concerned calls that people think they shouldn't have to pick it up, and we're fine with that. We'll send them to those who want it sent and we'll greet those who want to come down and see our smiling faces.

Are were you thinking about sending out a reminder email or anything to people since it's a new process?

We can do that and soften the need. If you don't want to just let us know and we'll send them out. But yeah, we'll do a reminder email through our database.
